Daniel Dodson, Attorney at Law, Jefferson City, MO., provides legal representation for DWI & traffic violations “Read this section carefully, because if you know your rights and get good representation, you might avoid the enormous costs of a DWI conviction, which go far beyond attorney fees.”

CRIMES & ACCUSATIONS

DWI & Traffic:

DWI:

The law requires that you take the breathalyzer at the police station only after the officer reads you the warning that you'll lose your license if you don't. YOU ARE NOT REQUIRED BY LAW TO ANSWER ANY QUESTIONS OR TO TAKE ANY OTHER TESTS, COMMONLY KNOWN AS FIELD SOBRIETY TESTS, SUCH AS THE ALPHABET, WALKING A LINE, FOLLOW-THE-PENCIL/FINGER, THE PORTABLE BREATH TEST, OR ANY OTHER.

IT IS ADVISABLE NOT TO DO SO UNTIL YOU'VE GOTTEN LEGAL ADVICE. If you believe you may be accused of DWI, CALL (573)636-9200 AS SOON AS YOU SEE THE LIGHTS COME ON.

Cars are important in most persons' lives. A bad break or two, especially if it involves a driving while intoxicated charge (DWI), can take away your mobility (and sometimes your livelihood), and make getting it back extremely expensive.

PLEASE, FOR THE SAKE OF ALL OF US, DO NOT DRIVE IF YOU ARE IMPAIRED TO ANY MEASURABLE DEGREE, BY ALCOHOL OR ANY OTHER SUBSTANCE. (Any depressant medication or drug [heroin, Oxycontin, Xanax, for example], can have effects similar to alcohol, or worse; stimulants and marijuana have not been proven to adversely affect driving to any significant degree, but that doesn't mean that some law enforcement personnel won't try to prosecute you for having them in your bloodstream, even long after the effects have passed.)

That being said, DWI LAWS HAVE BECOME IN MANY CASES, RIDICULOUSLY HARSH AND OVER PUNITIVE, AND ALMOST COMPLETELY INCAPABLE OF SEPARATING THE TRULY DANGEROUS FROM THOSE WHO, WHILE OVER THE LEGAL LIMIT, ARE UNLIKELY TO HARM ANYONE.

Therefore, it is even more important for drivers to educate themselves on avoiding the harshness of the law in this area.

DWI is an easy case for the state to prove, especially if the defendant is represented by counsel who does not have trial reputation and experience, and who doesn't know the intricate details of DWI law and evidence that allow the state's case to be put to the strictest test.

Even in a DWI case that can't be successfully defended to acquittal or won on a technical defense (the vast majority), an experienced and resourceful lawyer can apply knowledge of alternative punishments, treatment programs, and insurance and traffic law to achieve the best possible (least painful) resolution to a DWI case.
